  16. Suing for Amnesty

  18. <p>     When Congress passed its landmark amnesty bill in 1986, it
  19. was considered a triumph for illegal aliens seeking to
  20. normalize their status. But the act contained limited
  21. provisions for individuals to appeal the handling of their
  22. cases by the Immigration and Naturalization Service. Last week,
  23. by a 7-to-2 vote, the U.S. Supreme Court ruled that the law did
  24. not bar broader legal challenges to INS policies and practices
  25. that are deemed unfair and illegal.
  26. </p>
  27. <p>     The decision came in a class action filed on behalf of
  28. several thousand Haitian farm workers in Florida. The suit
  29. attacked flawed INS procedures, including the failure to
  30. provide transcripts and Creole translators during amnesty
  31. interviews. The ruling is expected to benefit more than 100,000
  32. other illegal aliens around the country whose representatives
  33. have been trying to haul the INS into court. Said victorious
  34. lawyer Ira Kurzban, echoing the view of other experts: "It's
  35. probably the most significant immigration case in the last
  36. quarter-century."
